Locations: Montreal - Ottawa - Toronto - other cities can be considered. The role As a Level II Legal Counsel, you will join the CBC/Radio-Canada Legal Services team. Reporting to the Executive Director, Privacy Protection and Records Management, you will provide legal expertise to ensure consistency and balance between the Corporation's business needs and compliance with applicable regulatory requirements in privacy protection. You will focus specifically on issues related to digital platforms and new technologies, including AI. You will also contribute to the implementation and evolution of the Corporation's privacy program. Key mandates and responsibilities: The Legal Counsel will be required to: Legal advice: Provide legal services to various operational sectors and advise internal teams on a variety of privacy protection issues to help sectors achieve their objectives while complying with laws and best practices. Compliance: Contribute to the evolution, adherence to, and maintenance of the Corporation's privacy program, helping it meet its obligations by ensuring compliance with the laws, regulations, policies, and directives applicable to federal Crown corporations. Technology and AI: Handle contractual matters in information technology related to privacy protection, notably on legal issues associated with CBC/Radio-Canada's various digital platforms, new technologies, and projects involving artificial intelligence (AI). Documentation and analysis: Lead and/or advise on Privacy Impact Assessments (PIAs). Review and draft documentation such as data processing agreements, privacy notices, and guidelines. Procurement support: Conduct preliminary checks of potential vendors regarding their privacy protection practices. Incident Management: Manage privacy breaches and work in concert with the information security team. Monitoring and Training: Develop and deliver training sessions and perform legal monitoring to understand and anticipate trends and legislative changes. Education and experience: Law degree and member of the Quebec or the Ontario Bar. 3 to 5 years of relevant experience in privacy protection, gained in-house or in private practice. Solid knowledge of Canadian privacy laws (federal and provincial) and knowledge of the Canada’s Anti-Spam Legislation (CASL). Experience in privacy breach management and in conducting Privacy Impact Assessments (PIAs). An interest in and good knowledge of technology law and artificial intelligence is an asset. Skills and qualities: Bilingualism (French and English) is mandatory, both oral and written. Superior oral and written communication skills, including the ability to simplify legal concepts and work with individuals whose knowledge of legal issues varies. Strong analytical skills and solid judgment. Ability to work under pressure with an important workload, to prioritize, and to handle emergencies efficiently. Ability to defend positions based on the common interest while contributing to the achievement of corporate objectives and reconciling compliance requirements with practical operational needs. Comfortable conducting negotiations leading to the conclusion of complex agreements. Candidates may be subject to skills and knowledge testing.
