Legal Services in the Office of General Counsel, People & Cuture is currently seeking a Full-time Temporary Relief Manager, Access and Privacyfor approximately 8 months.
The Manager, Access and Privacy oversees and manages the University of Calgary's access to information requests, and develops, coordinates, and implements policies, procedures, operating standards, and practices to manage the University's compliance with the Alberta Freedom of Information and Protection of Privacy Act, as soon to be replaced by the Protection of Privacy Act and Access to Information Act (Alberta Access and Privacy Legislation). Along with the General Counsel and Associate General Counsel (Corporate/Commercial and Privacy), the Manager, Access and Privacy is accountable for the University's compliance with all Alberta Access and Privacy Legislation.
The Manager, Access and Privacy position reports to the Associate General Counsel (Corporate/Commercial and Privacy) and works closely with other members of University Legal Services. It is an important leadership position, responsible for supervising and managing the work of three professional staff on the Access and Privacy team, and is accountable for their performance and results.
Summary of Key Responsibilities (job functions include but are not limited to):
- Responsible for developing capacity and expertise within the University Access and Privacy team.
- Responsible for being the lead University contact and representative for engaging with Alberta's Office of the Information and Privacy Commissioner (OIPC), which requires responding quickly to inquiries from OIPC officers and investigators.
- Manage requests for access to information by assessing the request and assigning it to a member of the Access and Privacy team, providing coaching and advice as needed, and ensuring all relevant timelines are met; may process requests independently depending on subject area, complexity, and workload.
- Respond to access requests in a timely, accurate and complete manner and manage challenging applicants in a way that defuses the situation.
- Advise leadership in advance of potentially controversial issues, such as disclosures of sensitive information.
- Monitor progress and workload among team members, including updating and managing the intake process for access requests and internal privacy advice.
- Collaborate extensively with the Privacy and Records Specialist in the Cumming School of Medicine and the IT Security team.
- Work closely with and support the lawyers in University Legal Services.
- Oversee and be the lead contact for University Legal Service's participation in the software acquisition process (along with IT Security and Supply Chain), ensuring appropriate data classifications are applied to software acquisitions, and assigning software agreement analysis and review to Access and Privacy staff, the CSM Privacy and Records Specialist, and the lawyers in University Legal Counsel based on analysis of the file's complexity.
- Manage the process for and evaluates internal requests for access to personal information held in the custody and control of the University to ensure compliance with Alberta Privacy Legislation.
- Responsible for responding to complaints and notices of a breach of the Privacy Policy, and delegates to team members as needed.
- Participate in privacy breach investigations, provides support to investigators, or conducts an initial investigation, in consultation with the University's investigations office. Monitor the progress of the investigation, develop or participate in mitigation, and monitor remediation.
- Responsible for any reporting of privacy breaches to the Office of the Information and Privacy Commissioner, if required.
- Responsible for designing, coordinating, and delivering programs of instruction for staff and academics on topics relating to access, privacy and information management, including overseeing the content and implementation of the University's required Privacy Awareness training program.
- Work with internal and external legal counsel as needed on complex access to information or privacy files and is able to identify when engagement and advice of legal counsel is required.
Qualifications / Requirements:
- University degree required, preferably at the graduate level; education, training and/or significant experience in federal and provincial access and privacy legislation is an asset.
- Legal training/law degree also considered an asset.
- Designation in access to information and/or privacy such as IAPP or CIPP/C certification.
- Familiarity with public sector governance structures and/or understanding of the post-secondary educational institution culture and organizational structure.
- Strong records management knowledge and understanding of best practices.
- Solid understanding of emerging privacy risks and challenges related to the proliferation of artificial intelligence and international data transfers.
- Highly developed conceptual and analytical abilities, and high level of interpersonal, communication, negotiation, and mediation skills.
- Demonstrated ability to lead and manage people effectively, with experience coaching, mentoring and advising junior team members and delegating less complex tasks.
- Experience solving complex problems, coordinating with multiple internal and external stakeholders and dealing with sensitive or confidential information.
- Strong communication skills with a demonstrated ability to understand complex problems and work closely with various leaders to ensure an efficient and effective solution.
